Terms and conditions of sale

1. The seller

Kotisso premium is sold by Eric Mollenthiel, sole trader, SIREN 795 225 226, 103 avenue Lacassagne, 69003 Lyon, France. Contact: team@kotisso.com. These terms supplement the terms of use, which govern the free part of the service.

2. What premium adds

Premium is a subscription that opens four things, and only four:

• 10 active groups at the same time, instead of 2;
• the display of the full history of a group's feed, instead of the last 12 months;
• a group's statistics page: month-by-month evolution, split by category and by person, averages and highlights;
• the avatar photo, instead of the initials. It is only served to the members of your groups, and you keep it if the subscription stops: you can always remove it, never replace it.

Everything else in Kotisso is free and stays free: expenses, balances, repayment plan, categories, approval of expenses by the participants, recurring expenses, invitations, live updates. Expenses older than the depth displayed are still counted in the balances of a free account: the accuracy of the accounts is never conditional on payment.

3. Price

€2.99 per month, or €24.99 per year. Prices include all taxes; VAT not applicable, article 293 B of the French General Tax Code. The price shown at the time of ordering is the one charged.

4. Order and payment

Subscription is done from the « My subscription » page of your account. Card payment is handled by Stripe: no bank details pass through Kotisso or are kept there. The subscription is concluded for the chosen duration (one month or one year), charged in advance, and tacitly renewed at each renewal date until cancellation.

5. Right of withdrawal

A distance purchase in principle opens a fourteen-day right of withdrawal, without justification (articles L221-18 et seq. of the French Consumer Code).

Premium is digital content supplied immediately: it opens as soon as payment is accepted, without waiting. When ordering, you are therefore asked to tick a box by which you expressly request this immediate start and acknowledge losing your right of withdrawal. This box is never pre-ticked, and without it the order does not go through. Once ticked, the right of withdrawal no longer applies, in accordance with article L221-28 13° of the French Consumer Code, and the amount paid is not refundable.

After payment, we send you an email confirming your order and this agreement: it is your proof, and ours. If you do not wish to waive your right of withdrawal, do not tick the box: the subscription then cannot be taken out, and the free plan remains whole and without time limit.

This waiver deprives you of no other right: you can cancel at any time (article 6), and the legal guarantee of conformity for digital content and services (articles L224-25-12 et seq. of the French Consumer Code) applies in all circumstances.

Should the right of withdrawal nevertheless be open to you, it is exercised by an unambiguous statement addressed to team@kotisso.com, or using the form below, and the refund is made within fourteen days by the same means of payment.

6. Cancellation

You can cancel at any time, in a few clicks, from the « My subscription » page (« Manage my subscription »). Cancellation takes effect at the end of the current period: premium stays open until then, no further payment is taken, and the period already started is not refunded pro rata.

After cancellation, you lose no data: your groups, your expenses and your balances stay intact and accessible for free. Only the depth of the feed and the number of active groups go back to those of the free plan; an account that then exceeds 2 active groups keeps them all, but can no longer create or join new ones before archiving some.

7. Tacit renewal

In accordance with article L215-1 of the French Consumer Code, an annual subscription is recalled to you by email between three months and one month before its renewal date, with the deadline for not renewing it. For the monthly subscription this information is moot: renewal can be refused at any time, without cost or notice, and the date of the next renewal is shown permanently on your « My subscription » page.

8. Price changes

Any change to the price or to what premium includes is notified to you by email at least thirty days before it applies. If it does not suit you, simply cancel before the next renewal date: a new rate never applies without your voluntarily staying subscribed.

9. Payment failure

If a payment fails, Stripe makes further attempts. Failing regularisation, premium closes and the account returns to the free plan, with no loss of data.

10. Consumer mediation

In accordance with articles L612-1 and L616-1 of the French Consumer Code, every consumer has the right to use a consumer mediator free of charge to settle a dispute with a professional amicably. The mediator Kotisso reports to is:

The mediator can only be referred to after a prior written complaint sent to team@kotisso.com has gone without a satisfactory answer. Referring the matter to the mediator is free of charge for the consumer.

11. Applicable law

These terms are governed by French law. In case of dispute, and after seeking an amicable solution, the French courts have jurisdiction.
